Hispatransfers has the mission of managing transportation reservations through its web page, assigning this service to individuals and companies. To this end, Hispatransfers operates with local transportation providers that provide passenger transport services, with all the permits and licenses required by the applicable regulations to carry out this activity. This service does not constitute in any case a combined trip, in the terms established in the Directive of the European Council 90/314 / EEC, dated June 13, 1990. Therefore, Hispatransfers does not work as a travel agency.
2. Users
The access and / or use of this website of Hispatransfers.com and the contracting of its services attributes the condition of User, who accepts the Terms and Conditions here reflected.
Once the User formalizes his reservation, he confirms that he has read, understands and accepts these conditions. It also confirms that it has the capacity and legal authority necessary to accept these general conditions in its own name and / or on behalf of its companions. 6. Reservation and payments
To formalize the reservation, the User may process their service through the Hispatransfers.com website or send an e-mail to info@hispatransfers.com The User must be of legal age and make sure that the information provided to make the reservation is correct. The required information will be:
- Contact details of the main passenger (name, surnames, telephone and e-mail)
- Origin and destination of the service
- Flight data / ship / train of origin
- Date and time of service
- Observations / Special needs
When the payment is received, Hispatransfers.com will send the User an e-mail and a PDF attachment as a voucher or confirmation of the reservation, where all the information of the same will be detailed, as well as the assistance phone number of Hispatransfers.com and special observations (if any). This reservation voucher will serve as a contract between Hispatransfers.com and the User, having as the date of the contract that which appears on the reservation confirmation document.
The User is recommended to read this information carefully and, in case of correction or modification, contact Hispatransfers.com to correct it. Hispatransfers.com will not be responsible for errors derived from incorrect information provided by the User.
The payment of reservations can be made through telephone, e-mail and / or Hispatransfers.com, through the following methods:
- Debit / credit card (Visa, Master Card, Maestro, JCB, Diner’s Club)
- Bank transfer: The User must make it with a maximum of 7 days prior to the completion of the service and send proof of it to Hispatransfers.com
- Paypal
Hispatransfers.com will make the reservation charge in Euros.
The notifications sent by Hispatransfers.com to the User, must be confirmed by him by e-mail. Failing Hispatransfers.com save the record of delivery of these notifications, serving as delivery confirmation.
7. Modifications of reservations
Any type of modification by the User that may affect the reservation or the information it contains, will be notified to Hispatransfers.com by e-mail to info@hispatransfers.com with an advance notice of up to 48 h. prior to the provision of the service. Any request for modification outside said period of time will be subject to availability by Hispatransfers.com and the local transport operator and, therefore, the User can not be confirmed until the corresponding inquiries have been made.
Hispatransfers.com will send a notification to the User by e-mail, confirming the modification in the reservation. Changes in reservation made by the User directly with the local operator, without confirmation by Hispatransfers.com, will not be valid.
If the modification requested by the User increases the final amount of the reservation, the latter must pay the difference in price. In the event that the final price is lower, Hispatransfers.com will pay the difference to the User (as long as the User notifies the modification of the reservation 48 hours in advance at the time the service is held).
In the event that Hispatransfers.com or the local operator need to modify the reservation, Hispatransfers.com will notify the User as soon as possible by e-mail and / or telephone contact and will not confirm the modification without the client’s consent.
8. Cancellations
The User must notify the cancellation of the reservation by e-mail to info@hispatransfers.com, with up to 24 h. in advance at the time of celebration of the service. In this way Hispatransfers.com will pay the User the full amount previously paid for the reservation. Only cancellation requests sent by the User through e-mail, not by other means (telephone, sms, social networks, etc.) will be valid.
If the User sends the notice of cancellation of reservation outside the period of time indicated in the previous paragraph, the Hispatransfers.com will not proceed to refund the amount of the reservation to the User.
In the event that Hispatransfers.com or the local operator are obliged to cancel the reservation, Hispatransfers.com will notify the User by e-mail and by telephone as soon as possible and proceed to the refund of the full amount previously paid for your reservation.
9. Insurance and liability
Hispatransfers.com recommends the User to contract a travel insurance policy that can cover any type of risk or complication derived from any unwanted eventuality that is not within the responsibility of Hispatransfers.com.
Hispatransfers.com will not be responsible for any damage or loss that is not directly attributed to him or that caused by accident, force majeure or that is motivated by legal or administrative requirements. Likewise, Hispatransfers.com will not be responsible for any incident that may occur during the provision of the service, such as personal injury, illness or death, unless they are the direct consequence of negligence on the part of Hispatransfers.com. In addition, Hispatransfers.com will not be responsible for any management or modification that the User makes directly with the local transport operator and that may result in any type of damage or harm to the User.
In case of damage or loss in the provision of the service directly attributable to Hispatransfers.com, the User will be reimbursed as much as possible for the amount previously paid to Hispatransfers.com; provided that the User demonstrates in a reliable manner the failure to provide the service.
Hispatransfers.com is not responsible, in any case, for damages of any kind that may cause, by way of example: errors or omissions in the content, lack of availability of the website or the transmission of viruses or malicious programs or harmful to the contents of your website, despite having adopted all necessary technological measures to avoid it.
10. Fuerza Mayor
Hispatransfers.com no puede hacerse responsable de situaciones extraordinarias que puedan afectar previamente a la prestación del servicio. Estas circunstancias pueden ser accidentes de tráfico de terceros; actos de terrorismo; actos de protesta, manifestaciones y disturbios; controles policiales; peligros imprevistos; actos de gobierno o autoridad nacional; desastres naturales o catástrofes; fenómenos meteorológicos adversos u otros acontecimientos similares.
11. Servicio de transporte
El Usuario será responsable de que la información proporcionada en su reserva (datos personales, fechas y horas, número de pasajeros y lugares de recogida y destino) sea correcta. Hispatransfers.com comunicará estos datos al operador local, con objeto de que el conductor lleve y/o recoja al Usuario en el punto más cercano a su punto de partida / destino y siempre en función de las características del vehículo y de la accesibilidad de la dirección indicada por el Usuario. En caso de que el Usuario se encuentre en el lugar, fecha y hora acordados en la reserva y no pueda encontrar al conductor, deberá llamar al número de asistencia telefónica de Hispatransfers.com facilitado en el bono de reserva; de este modo Hispatransfers.com contactará con el operador local para que conductor y Usuario se encuentren y pueda proporcionarse el servicio. El tiempo de espera por parte del conductor al Usuario será de diez minutos (excepto para recogidas en aeropuertos, puertos de cruceros y estaciones de tren). Si el Usuario no apareciese durante dicho periodo de tiempo, Hispatransfers.com intentará contactar con el Usuario para proceder a la prestación del servicio. Si esto último no fuera posible, Hispatransfers.com podrá autorizar la marcha del conductor sin el Usuario y no habría ninguna posibilidad de reembolso por parte de Hispatransfers.com para el Usuario.
Respecto a recogidas en aeropuertos, puertos de cruceros y estaciones de tren, el conductor esperará al Usuario en la terminal de llegadas, bien a la salida del vuelo / crucero / tren del que procede el Usuario; o bien en un punto de encuentro específico para recogida de pasajeros (en este caso Hispatransfers.com lo indicará en el bono de reserva). Asimismo, el conductor esperará al Usuario por un periodo máximo de 60 minutos (este plazo de espera es únicamente aplicable al tipo de servicios detallados en este párrafo), siendo no reembolsable la reserva para el Usuario si éste no se presenta dentro de dicho periodo de tiempo. El Usuario será responsable de proporcionar los datos correctos del vuelo / crucero / tren del que procede (número de vuelo / nombre del crucero / procedencia del tren, fecha y hora de llegada) y de comprobar que esta información es correcta, una vez recibida la confirmación de reserva por parte de Hispatransfers.com. En caso de no poder prestarse el servicio debido a un error por parte del Usuario en dicha información facilitada a Hispatransfers.com, no habrá posibilidad de reembolso para el Usuario por parte de Hispatransfers.com
Para servicios hacia aeropuertos, puertos de cruceros y estaciones de tren, el Usuario será responsable de que la fecha y hora de salida facilitadas a Hispatransfers.com del vuelo / crucero / tren que va a tomar sean correctas. Asimismo, el Usuario será responsable de comprobar la hora de recogida por parte del conductor y que la hora de llegada final al aeropuerto / puerto de cruceros / estación de tren sea al menos diez minutos antes de la hora de apertura del mostrador de facturación y siempre una hora antes de la hora de salida del vuelo / crucero / tren que el Usuario va a tomar. Por tanto, Hispatransfers.com no se responsabilizará de cualquier caso de pérdida de vuelo / crucero / tren por parte del Usuario que venga derivado de una información errónea proporcionada por el Usuario a Hispatransfers.com, ni de ningún coste adicional que ello pudiera acarrear.
Si en la reserva figuran niños, será responsabilidad del Usuario el comunicarlo a Hispatransfers.com durante el proceso de reserva. Hispatransfers.com podrá ofrecer al Usuario la contratación de los sistemas de sujeción especiales para niños durante la prestación del servicio, siempre bajo la disponibilidad de estos elementos por parte del operador local. En caso de que el Usuario proceda a la contratación de dichos elementos y finalmente no fueran proporcionados en el servicio, Hispatransfers.com procederá a la devolución al Usuario del importe únicamente de los sistemas de sujeción para niños no facilitados, nunca a la devolución del servicio de transporte. Además, todos los niños serán contabilizados como pasajeros.
Todos los vehículos de los operadores locales de transporte disponen de las licencias administrativas y seguros obligatorios para la prestación del servicio de transporte de pasajeros.
12. Equipaje
El equipaje permitido por cada pasajero es de una maleta con medidas máximas combinadas de 158 cm. (longitud / anchura / profundidad). El Usuario será responsable de informar a Hispatransfers.com de la cantidad de equipaje incluido en la reserva y de llevarlo debidamente identificado durante la prestación del servicio, ya que Hispatransfers.com no se responsabilizará de ningún equipaje extraviado sin identificar. Asimismo, el Usuario será responsable de los costes que puedan acarrear en caso de precisar algún vehículo adicional para transportar mayor cantidad de equipaje al permitido en estos términos y condiciones.
En caso olvido de equipaje en el vehículo por parte del Usuario, será responsabilidad de éste el comunicarlo a Hispatransfers.com para su devolución, siendo por cuenta del Usuario los costes que pudieran conllevar la entrega de equipaje o cualquier elemento olvidado. Asimismo, Hispatransfers.com no se responsabilizará de ningún caso de daño o pérdida de equipaje, ya que éste es responsabilidad del usuario y puede cubrir estos posibles riesgos con una póliza de seguros (Hispatransfers.com aconseja al Usuario contratar siempre un seguro de viajes para hacer frente a posibles daños o pérdidas).
La aceptación de estos Términos y Condiciones obligarán al Usuario a no transportar en su equipaje artículos prohibidos (armas, estupefacientes, sustancias peligrosas, etc.) que se contemplen en la legislación vigente; ni animales (a no ser que el Usuario haya informado previamente a Hispatransfers.com y los animales se transporten en el contenedor adecuado); ni objetos frágiles y/o perecederos; ni elementos de peso y tamaño que excedan de la capacidad del vehículo reservado.
13. Responsabilidad del Usuario
Confirmando la aceptación de este contrato, el Usuario declara que es mayor de edad y se encuentra capacitado para acometer las responsabilidades que se le reconocen en el contrato y en estos términos y condiciones. Asimismo el Usuario declara que las tarjetas de débito/crédito utilizadas para reservar con Hispatransfers.com, son de su uso autorizado y están provistas de los fondos requeridos para cubrir el importe del servicio. Será responsabilidad del Usuario el informar con la mayor brevedad posible a Hispatransfers.com de cualquier modificación de los datos que ha facilitado y que puedan afectar a la reserva y al servicio.
El servicio se llevará a cabo conforme a los datos que el Usuario ha proporcionado a Hispatransfers.com en el proceso de reserva. El Usuario será responsable de que la información que aparece en la confirmación de reserva enviada por Hispatransfers.com, sea correcta. En caso contrario, el Usuario deberá informar con un mínimo de 12 h. de anterioridad a la prestación del servicio a Hispatransfers.com con objeto de efectuar las correcciones pertinentes. Por tanto, Hispatransfers.com no será responsable de ningún servicio que no pueda llevarse a cabo debido a información errónea proporcionada por el Usuario y, por consiguiente, no procederá a realizar ningún reembolso al Usuario.
El Usuario será responsable de llevar consigo la documentación necesaria para el cruce de fronteras. Hispatransfers.com no se responsabilizará de ningún coste ocasionado por no portar esta documentación o no cumplir con las normativas de aduanas, policiales, fiscales o administrativas del país al que el Usuario pretenda solicitar entrada. El bono de reserva no se considerará como documento válido para obtener un visado.
En caso de que Hispatransfers.com se encontrara en la obligación de hacer frente a un depósito o multa económica como consecuencia de un incumplimiento por parte del Usuario de las leyes, normativas o cualquier otro requisito legal del país al que se pretenda acceder, abandonar o transitar, será responsabilidad del Usuario el hacer frente a dicha suma o Hispatransfers.com tendrá derecho a retener cualquier cantidad de dinero previamente abonada por el Usuario, hasta que éste demuestre haber formalizado el pago de la sanción o multa.
14. Derecho de admisión
Hispatransfers.com y el operador local tendrán derecho a negarse a prestar el servicio a cualquier Usuario y acompañante que se encuentre bajo los efectos de alcohol o sustancias estupefacientes y que pueda afectar a la normal prestación del servicio o a la seguridad de otros pasajeros, el conductor y/o el vehículo. Hispatransfers.com no será responsable de ningún coste añadido que pueda llevarse a cabo debido al resultado de dicha conducta por parte del Usuario y sus acompañantes.
Hispatransfers.com no permitirá el consumo de alcohol en los vehículos ni de estupefacientes u otras sustancias prohibidas. Asimismo, Hispatransfers.com informa que está prohibido fumar en el interior de los vehículos.
15. Generalidades
Hispatransfers.com perseguirá el incumplimiento de las presentes condiciones así como cualquier utilización indebida de su portal y de sus servicios ejerciendo todas las acciones civiles y penales que le puedan corresponder en derecho.
16. Modificación de los presentes Términos y Condiciones y duración
Hispatransfers.com podrá modificar en cualquier momento las condiciones aquí determinadas, siendo debidamente publicadas como aquí aparecen.
La vigencia de las citadas condiciones irá en función de su exposición y estarán vigentes hasta que sean modificadas por otras.
17. Legislación aplicable y jurisdicción
La relación entre Hispatransfers.com y el Usuario se regirá por la normativa española vigente y cualquier controversia se someterá a los Juzgados y tribunales de la ciudad de Sevilla.
