Please read these terms and conditions carefully, as they must be accepted by the customer in order for the booking to be completed.

1. Identification data and mission

In compliance with the duty of information contained in article 10 of Law 34/2002, of 11 July, of Services of the Information Society and Electronic Commerce, the following data are reflected below: the owner company of Hispatransfers.com is Hispatransfers SL (hereinafter Hispatransfers), with address for these purposes at Avda Hytasa 12, 2° planta, mod. 6 – 41006 – Sevilla (Spain), C.I.F. number: B90293358 and registered in the Mercantile Register of Seville – Volume 6285 Folio 90 Page Nº SE 111682 1st Inscription. Contact e-mail address: info@hispatransfers.com.

Hispatransfers’ mission is to manage transport bookings through its website, e-mail and/or telephone, providing this service to individuals and companies. For this purpose, Hispatransfers operates with its own fleet of vehicles as well as with local transport providers, providing the passenger transport service and having all the permits and licenses required by the applicable regulations to carry out this activity. This service does not in any case constitute a combined trip, in the terms established in the European Council Directive 90/314/EEC, dated 13 June 1990. Therefore, Hispatransfers does not work as a travel agency.

2. Users

The access and/or use of this web portal of Hispatransfers.com and the contracting of its services attributes the condition of User, who accepts the Terms and Conditions here reflected.

Once the User has made a reservation, he/she confirms that he/she has read, understands and accepts these conditions. He/she also confirms that he/she has the capacity and legal authority to accept these general conditions in his/her own name and/or on behalf of those accompanying him/her. Therefore, he/she is responsible for making the appropriate payments and for notifying any modification or cancellation of the booking.

3. Website

Hispatransfers.com provides access to a multitude of information, services, programmes or data (hereinafter, “the contents”) on the Internet belonging to Hispatransfers or its licensors to which the User may have access. The User assumes responsibility for the use of the portal.

The User undertakes to make appropriate use of the contents and services that Hispatransfers.com may offer through its portal and, by way of example but not limitation, not to use them for (i) engaging in illicit or illegal activities or those contrary to good faith and public order; (ii) disseminating content or propaganda of a racist, xenophobic, pornographic-illegal nature, in support of terrorism or against human rights; (iii) causing damage to the physical and logical systems of Hispatransfers.com, its suppliers or third parties, introduce or spread computer viruses or any other physical or logical systems that could cause the aforementioned damage; (iv) attempt to access and, where appropriate, use the e-mail accounts of other users and modify or manipulate their messages; (v) attempt to access and, where appropriate, use the e-mail accounts of other users and modify or manipulate their messages.

Hispatransfers.com by itself or as an assignee, is the owner of all the intellectual and industrial property rights of its website, as well as of the elements contained therein (including but not limited to images, sound, audio, video, software or texts; brands or logos, colour combinations, structure and design, selection of materials used, computer programmes necessary for its operation, access and use, etc.), owned by Hispatransfers.com or by its licensors.

Hispatransfers.com reserves the right to carry out without previous warning the modifications that it considers opportune in its portal, being able to change, suppress or add so much the contents and services that are lent through the same one as the form in which these appear presented or located in its portal.

Pursuant to the provisions of articles 8 and 32.1, second paragraph, of the Intellectual Property Law, the reproduction, distribution and public communication, including the making available modality, of all or part of the contents of this website, for commercial purposes, in any medium and by any technical means, without the authorisation of Hispatransfers.com, are expressly prohibited. The User undertakes to respect the rights of Intellectual and Industrial Property owned by Hispatransfers.com.

4. Languages

The Hispatransfers.com website is available in Spanish and English. Likewise, Hispatransfers.com also guarantees customer service in these two languages, both by telephone and e-mail.

Hispatransfers.com tries to take care of the translation quality of its website. However, in case of disagreement and for legal purposes, the Spanish version is the one that will be considered valid.

5. Data protection

Hispatransfers.com complies with the guidelines of the Organic Law 15/1999 of 13 December on the Protection of Personal Data, the Royal Decree 1720/2007 of 21 December which approves the Regulation of development of the Organic Law and other regulations in force at all times, and ensures the correct use and treatment of the user’s personal data. To this end, together with each form for the collection of personal data, in the services that the user may request to info@hispatransfers.com, hará saber al usuario de la existencia y aceptación de las condiciones particulares del tratamiento de sus datos en cada caso, informándole de la responsabilidad del fichero creado, la dirección del responsable, la posibilidad de ejercer sus derechos de acceso, rectificación, cancelación u oposición, la finalidad del tratamiento y las comunicaciones de datos a terceros en su caso.

Likewise, Hispatransfers.com informs that it gives fulfillment to the Law 34/2002 of July 11, of Services of the Society of the Information and the Electronic Trade and will request to the User its consent to the treatment of its electronic mail with commercial aims in every moment.

Therefore, all communication with Hispatransfers.com by any means or through your e-mail address, or the forms on this website or your e-mail, implies the express consent for the personal data of the interested party to be incorporated into files owned by Hispatransfers.com belonging to Hispatransfers SL, whose address is Avda Hytasa 12, 2° planta, mod. 6 – 41006 – Sevilla (Spain) and used to process the reservation and in order to receive offers and promotions of services by Hispatransfers.com.

This personal data will be processed in accordance with the provisions of Organic Law 15/1999, of 13 December, on the Protection of Personal Data.

Therefore, the interested party may exercise the right of access, rectification, cancellation and opposition with respect to the personal data contained in the aforementioned files, and may revoke their consent in writing at any time.

They may do so by written communication addressed to info@hispatransfers.com

6. Reservation and payments

In order to formalise the reservation, the User can process the service through the Hispatransfers.com website or send an e-mail to info@hispatransfers.com. The User must be of legal age and must ensure that the information provided to make the reservation is correct. The information required shall be:

• Contact details of the main passenger (name, surname, first name, telephone and e-mail)
• Origin and destination of the service
• Originating flight/ship/train data
• Date and time of service
• Remarks / Special needs

When the payment is received, Hispatransfers.com will send to the User an e-mail as confirmation of the reservation, where all the information of the same one will be detailed, as well as telephone number of assistance of Hispatransfers.com and special observations (in case there were them). This reservation e-mail will serve as a contract between Hispatransfers.com and the User, and the date of the contract will be the date that appears in the reservation confirmation document.

It is recommended to the User, to read this information carefully and, in case of correction or modification, to contact with Hispatransfers.com to correct it. Hispatransfers.com will not be held responsible for errors derived from incorrect information provided by the User.

The payment of the reservations can be made by telephone, e-mail and/or Hispatransfers.com, by the following methods:

• Debit/credit card (Visa, Master Card, Maestro, JCB, Diner’s Club).
• Bank transfer: The User will have to make it with 2 days of maximum anticipation to the accomplishment of the service and to send voucher of the same one to Hispatransfers.com.

Hispatransfers.com will charge the reservation in Euros.

The notifications sent by Hispatransfers.com to the User, will have to be confirmed by this one by means of e-mail. Failing this, Hispatransfers.com will keep the delivery record of said notifications, serving as delivery confirmation.

7. Modifications to reservations

Any type of modification by the User that may affect the reservation or the information it contains, will be notified to Hispatransfers.com by e-mail to info@hispatransfers.com up to 48 hours before the service is to be provided. Any request of modification outside this period of time will be subject to availability on the part of Hispatransfers.com and the local transport operator and, therefore it will not be able to be confirmed to the User until having carried out the corresponding consultations.

Hispatransfers.com will send a notification to the User by e-mail, confirming the modification in the reservation. Modifications made by the User directly with the local operator will not be valid without confirmation from Hispatransfers.com.

If the modification requested by the User increases the final amount of the reservation, the User shall pay the difference in price. In case the final price is lower, Hispatransfers.com will pay the difference to the User (as long as the User notifies the modification of the reservation 48 hours before the time of the service).

In case Hispatransfers.com or the local operator needs to modify the reservation, Hispatransfers.com will notify the User as soon as possible by e-mail and/or telephone contact and will not confirm the modification without the client’s consent.

8. Cancellations

The User must notify the cancellation of the reservation by e-mail to info@hispatransfers.com, up to 24 hours before the time of the service. In this way Hispatransfers.com will pay the user the full amount previously paid for the reservation. Only cancellation requests sent by the User via e-mail will be valid, not by other means (telephone, sms, social networks, etc.).

If the User sends the notification of cancellation of reservation out of the term of time indicated in the previous paragraph, Hispatransfers.com will not proceed on the part of Hispatransfers.com the refund of the amount of the reservation to the User.

In case Hispatransfers.com or the local operator is in the obligation to cancel the reservation, Hispatransfers.com will notify the User by e-mail and telephone as soon as possible and will proceed to reimburse the total amount previously paid for the reservation.

9. Insurance and liability

Hispatransfers.com recommends the User to contract a travel insurance policy that can cover any type of risk or complication derived from some undesired eventuality and that is not located within the responsibility of Hispatransfers.com.

Hispatransfers.com will not be responsible for any damage or harm that is not directly attributed to it or for that produced by accident, force majeure or that is motivated by legal or administrative requirements. Likewise, Hispatransfers.com will not be responsible for any incident that takes place during the provision of the service, such as personal injury, illness or death, unless they are a direct consequence of negligence on the part of Hispatransfers.com. Furthermore, Hispatransfers.com shall not be responsible for any management or modification that the User may carry out directly with the local transport operator and that may derive in any type of damage or harm to the User.

In case of damage or harm in the provision of the service directly attributable to Hispatransfers.com, the maximum amount previously paid to Hispatransfers.com will be refunded to the User, as long as the User demonstrates in a reliable way the failure in the provision of the service.

Hispatransfers.com is not responsible, in any case, of the damages and damages of any nature that could cause, by way of example: errors or omissions in the contents, lack of availability of the web site or the transmission of virus or malicious or harmful programs in the contents of its web site, in spite of having adopted all the technological measures necessary to avoid it.

10. Force Majeure

Hispatransfers.com cannot be held responsible for extraordinary situations that may previously affect the provision of the service. These circumstances may include third party traffic accidents; acts of terrorism; acts of protest, demonstrations and riots; police checks; unforeseen dangers; acts of government or national authority; natural disasters or catastrophes; adverse weather phenomena or other similar events.

11. Transport service

The User shall be responsible for the correctness of the information provided in his/her booking (personal details, dates and times, number of passengers and pick-up and drop-off locations). Hispatransfers.com will communicate this information to the local operator, in order for the driver to take and/or pick up the User at the closest point to their point of departure / destination and always depending on the characteristics of the vehicle and the accessibility of the address indicated by the User.  In the event that the User is at the place, date and time agreed upon in the reservation and cannot find the driver, he/she must call the Hispatransfers.com telephone assistance number provided in the reservation voucher; in this way Hispatransfers.com will contact the local operator so that the driver and User can meet and the service can be provided. The waiting time for the driver to meet the User will be ten minutes (except for pick-ups at airports, cruise ports and train stations). If the User does not appear during this period of time, Hispatransfers.com will try to contact the User to proceed with the provision of the service. If the latter is not possible, Hispatransfers.com will be able to authorise the departure of the driver without the User and there will be no possibility of reimbursement by Hispatransfers.com for the User.

With regard to pick-ups at airports, cruise ports and train stations, the driver will wait for the User at the arrivals terminal, either at the departure of the flight / cruise / train from which the User comes; or at a specific meeting point for passenger pick-up (in this case Hispatransfers.com will indicate this on the booking voucher). Likewise, the driver will wait for the User for a maximum period of 60 minutes (this waiting period is only applicable to the type of services detailed in this paragraph), and the reservation is non-refundable for the User if he/she does not show up within this period of time. The User shall be responsible for providing the correct flight / cruise / train details (flight number / name of the cruise / origin of the train, date and time of arrival) and for checking that this information is correct, once the booking confirmation has been received from Hispatransfers.com. In the event that the service cannot be provided due to an error on the part of the User in the information provided to Hispatransfers.com, there will be no possibility of reimbursement for the User by Hispatransfers.com.

For services to airports, cruise ports and train stations, the User shall be responsible for ensuring that the date and time of departure provided to Hispatransfers.com for the flight / cruise / train that he/she is going to take are correct. Likewise, the User shall be responsible for checking the pick-up time by the driver and that the final arrival time at the airport / cruise port / train station is at least ten minutes before the opening time of the check-in desk and always one hour before the departure time of the flight / cruise / train that the User is going to take. Therefore, Hispatransfers.com shall not be held responsible for any case of missed flight / cruise / train on the part of the User derived from erroneous information provided by the User to Hispatransfers.com, nor for any additional cost that this may entail.

If children are included in the reservation, it will be the responsibility of the User to inform Hispatransfers.com during the reservation process. Hispatransfers.com will be able to offer the User the contracting of special restraint systems for children during the provision of the service, always subject to the availability of these elements on the part of the local operator. In the event that the User proceeds to contract these elements and they are not provided in the service, Hispatransfers.com will refund the User the amount only for the child restraint systems not provided, never the refund of the transport service. In addition, all children will be counted as passengers.

All vehicles, both those owned by Hispatransfers< wpml_nbsp >and those owned by local transport operators, have the administrative licences and insurance required to provide passenger transport services.

12. Luggage

The luggage allowed for each passenger is one suitcase with maximum combined dimensions of 158 cm (length / width / depth). The User will be responsible for informing Hispatransfers.com of the amount of luggage included in the reservation and to carry it properly identified during the provision of the service, as Hispatransfers.com will not be responsible for any unidentified lost luggage. Likewise, the User shall be responsible for the costs that may arise in the event that an additional vehicle is required to transport a larger amount of luggage than that permitted in these terms and conditions.

In case of luggage forgotten in the vehicle by the User, it will be the responsibility of the User to communicate it to Hispatransfers.com for its return, being the User responsible for the costs that could entail the delivery of luggage or any forgotten element. Likewise, Hispatransfers.com shall not be responsible for any case of damage or loss of luggage, since this is the responsibility of the user and can cover these possible risks with an insurance policy (Hispatransfers.com advises the User to always contract travel insurance to cover possible damages or losses).

The acceptance of these Terms and Conditions will oblige the User not to transport in his/her luggage prohibited articles (weapons, narcotics, dangerous substances, etc.) that are contemplated in the current legislation; nor animals (unless the User has previously informed Hispatransfers.com and the animals are transported in the appropriate container); nor fragile and/or perishable objects; nor elements of weight and size that exceed the capacity of the reserved vehicle.

13. User Responsibility

By confirming acceptance of this contract, the User declares that he/she is of legal age and is capable of undertaking the responsibilities recognised in the contract and in these terms and conditions. Also the User declares that the debit/credit cards used to reserve with Hispatransfers.com, are of his authorized use and are provided with the funds required to cover the amount of the service. It will be the responsibility of the User to inform Hispatransfers.com as soon as possible of any modification of the data that he/she has provided and that may affect the reservation and the service.

The service will be carried out in accordance with the data that the User has provided to Hispatransfers.com in the booking process. The User will be responsible for the correctness of the information that appears in the booking confirmation sent by Hispatransfers.com. If this is not the case, the User must inform Hispatransfers.com at least 12 hours prior to the provision of the service in order to make the pertinent corrections. Therefore, Hispatransfers.com shall not be responsible for any service that cannot be carried out due to erroneous information provided by the User and, consequently, shall not proceed to make any reimbursement to the User.

The User will be responsible for carrying the necessary documentation for crossing borders. Hispatransfers.com will not be responsible for any cost caused by not carrying this documentation or not complying with the customs, police, fiscal or administrative regulations of the country to which the User intends to request entry. The booking voucher will not be considered as a valid document for obtaining a visa.

In the event that Hispatransfers.com finds itself in the obligation to pay a deposit or economic fine as a consequence of a breach by the User of the laws, regulations or any other legal requirement of the country to which the User intends to access, leave or transit, it will be the responsibility of the User to pay such sum or Hispatransfers.com will have the right to retain any amount of money previously paid by the User, until the User proves to have formalised the payment of the sanction or fine.

14. Right of admission

Hispatransfers.com and the local operator shall have the right to refuse to provide the service to any User and companion who is under the influence of alcohol or narcotic substances and who may affect the normal provision of the service or the safety of other passengers, the driver and/or the vehicle. Hispatransfers.com shall not be responsible for any additional costs that may be incurred as a result of such conduct on the part of the User and his/her companions.

Hispatransfers.com will not allow the consumption of alcohol in the vehicles or narcotics or other prohibited substances. Also, Hispatransfers.com informs that it is forbidden to smoke inside the vehicles.

15. General

Hispatransfers.com will pursue the breach of the present conditions as well as any undue use of its portal and its services exercising all the civil and penal actions that can correspond to him in right.

16. Modification of these Terms and Conditions and their duration

Hispatransfers.com will be able to modify at any time the conditions here determined, being properly published as they appear here.

The validity of these conditions shall depend on their exposure and shall remain in force until modified by other conditions.

17. Applicable law and jurisdiction

The relationship between Hispatransfers.com and the User shall be governed by current Spanish legislation and any dispute shall be submitted to the Courts and Tribunals of the city of Seville.
